Welcome to Airpaz.com! Airpaz (hereinafter referred to as “Airpaz”, “we”, “our”, “ourselves”, “us” and other similar expressions) operates and owns Airpaz.com and its corresponding web and mobile application(s) (hereinafter collectively referred to as the “Platform”). Airpaz is one of the leading flight, hotel, property and accommodation booking platform in Asia Pacific since its establishment in 2011. Airpaz takes pride in its all-embracing services as an Online Travel Agent (OTA). The Platform allows its users to secure online bookings, purchase Tickets (as further defined) and access information regarding flights, hotels and travel.
1. Acceptance of these Terms and Conditions
Prior to booking any reservations and purchasing Tickets on the Platform, it is essential for you to understand your legal obligations and rights with respect to the Platform. We therefore encourage you to carefully review these Terms and Conditions as they govern your usage of the Platform, its features and content. Your usage of the Platform is conditional upon your acceptance of these Terms and Conditions, in full and without restriction. Upon accessing, visiting or using the Platform, you agree to be bound and governed by these Terms and Conditions, in full, as though you manually signed them. These Terms and Conditions will be binding and applicable to you. Any usage of the Platform, even accessing or browsing, will be construed as your acceptance of these Terms and Conditions in full. If you do not agree with any portion of these Terms and Conditions, your sole recourse is to not access or use the Platform.
2. Updates to these Terms and Conditions
We reserve the right to update these Terms and Conditions, at any time, at our discretion. The most recent version of these Terms and Conditions will be published on the Platform, and will specify the date of the latest update. While we will use reasonable efforts to notify you of changes to these Terms and Conditions, we cannot guarantee that you will be informed of changes to these Terms and Conditions prior to their publication on the Platform. Consequently, you are encouraged to periodically review these Terms to ensure you comply with the latest version thereof. All updates to these Terms and Conditions will be binding as of the date specified in the header of these Terms and Conditions. Any usage of the Platform following to the publication of the updated Terms and Conditions will constitute your agreement to be bound by such updated Terms and Conditions.
3. About Our Services
i. Definitions In these Terms and Conditions, the following capitalized terms will have the meanings specified below, with regard to flights and travel: a. “Baggage” means the personal luggage you bring on your flight trip, including both your checked and unchecked baggage. b. “Itinerary” or “Travel Itinerary” means the document issued by Airpaz to the passenger, containing Airpaz code, the passenger(s)’ names, flight information (including but not limited to booking code, flight route, and flight schedule), terms and conditions of the contract, and applicable notices. c. “Passenger”, “you”, “your” and other similar expressions mean any person, who purchases a Ticket for purposes of booking a flight. d. “Terms and Conditions” refer to the present Terms and Conditions, which apply between Airpaz and anyone using Airpaz’s services and/or Platform. Depending on the context, Terms and Conditions may also refer to the Terms and Conditions of a relevant third party service provider, such as an airline and/or property/accommodation. e. “Ticket” means the Itinerary issued by us or on our behalf including the contractual terms and conditions, relevant booking details, and appropriate notices. Ticket will also refer to any booking for a property/accommodation made on the Platform. In these Terms and Conditions, the following capitalized terms will have the meanings specified below, with regard to hotels, properties and/or accommodations and guests: a. “Guest”, “you”, “your” and other similar expressions means any person who uses Airpaz’s services to reserve and book a certain Property/Accommodation. b. “Property Facilities and Services” means the facilities and services provided by the Property/Accommodation, subject to the reservation and booking. c. “Property Type” means the type of Property/Accommodation that can be selected for reservation and booking purposes. d. “Property/Accommodation” means any hotel, property and/or accommodation listed on Airpaz’s Platform, and/or subject to the booking. e. “Review” means the rating and evaluation of each Property/Accommodation given by the Guest(s) who stayed at such Property/Accommodation. i. “Room Info” means the detailed information about particular room(s) at a Property/Accommodation that may be selected by the Guest. j. “Star Rating” means the rating system of each Property/Accommodation based on the quality of the Property/Accommodation itself, its services and facilities. The Platform may feature various Properties/Accommodations, and descriptions, which may include the Property Type, the Property Facilities and Services offered, Room Info, as well as Reviews and Star Ratings. ii. Headers The title or caption of each article of these Terms & Conditions is used for convenience only and should not be relied upon for interpretation purposes.
4. Our Role and Limitation
We act as the official agent on behalf of airlines, flights and Properties/Accommodations. While we do serve as their official agent, please note and understand that we do not run these services ourselves. Our role is limited to that of an intermediary between you and the third party service providers (which include airlines and Properties/Accommodations). We have no control over the quality and execution of the services provided by the airlines, flights and Properties/Accommodations. You acknowledge and agree that we are only responsible for our booking service, to the extent laid out in these Terms and Conditions. As such, we act on your behalf for booking purposes by creating a virtual email address and providing your payment details to the third party service providers. Considering we do not provide the air transportation services nor the Property/Accommodation rental services, we will not be held responsible if your Baggage is lost, damaged, stolen or otherwise unavailable to you.
5. Provision of our Services
You understand that upon booking and reserving a flight via the Platform, you will be subject to and governed by these Terms and Conditions. These Terms and Conditions will specify our limited liability with respect to the flight reserved and booked, including with respect to your Baggage and air transportation. You further understand that upon booking and reserving a Property/Accommodation via the Platform, you will be subject to and governed by these Terms and Conditions. These Terms and Conditions will specify our limited liability with respect to the Property/Accommodation reserved and booked, including with respect to the Property Type.
6. E-Tickets / Itinerary / Booking Code
i. Proof of Contract Upon purchasing a Ticket on the Platform, you understand that these Terms and Conditions will govern the provision of the Ticket, your usage thereof and our limited liability. The terms contained in the Ticket, such as pricing, notices and relevant booking information together with these Terms and Conditions, will be binding upon you. The Ticket purchased and provided to you as an e-ticket, Itinerary or booking code will constitute your proof of purchase. ii. Transferability You may not transfer a Ticket you purchased, except in compliance with these Terms and Conditions. iii. Validity The Itinerary provided along with the booking code will only be valid for: (i) the Passenger or Guest named in the booking and (ii) the flight or Property/Accommodation specified therein. iv. Identity Airpaz will provide the booking code and flight and/or Property/Accommodation information solely to the Passenger or Guest named in the Itinerary. For identification purposes, the Passenger or Guest’s identification documentation (ID), such as passports and other relevant information, will be required during the check-in process.
7. Fares
i. General A. Flights Fares charged for Tickets are applied only for the flight service. The flight service refers to the total fee as of the flight’s departure until its arrival. Unless otherwise specified by Airpaz, fares exclude ground transport service. Airpaz will not be responsible for ensuring you meet any connecting flights, and will not be liable for your failure to meet your connecting flight(s) and missing any connecting flight(s). If you purchased a trip which involves more than one (1) participating airline, you understand that you will be subjected to the Terms and Conditions of each respective airline providing the flight(s) purchased. B. Property/Accommodation The pricing displayed on the Platform for Property/Accommodation rentals are solely for room reservations. The pricing will not include taxes and fees for certain Property Facilities and Services. Airpaz will not be responsible in case of your dissatisfaction with the Property/Accommodation, the Property Facilities and Services, and action or omission relating to or by the Property/Accommodation including but not limited to any inaccurate descriptions on the Platform, and any Reviews and Star Ratings found to be misleading. As an intermediary, we have no control over whether the information provided by the Property/Accommodation is true and accurate. ii. Infants A. Flight Airpaz can provide Tickets for infants if you wish to travel with your infant. The fee for the infant’s flight depends on the applicable airline’s policy fare. The number of infants may be limited per flight due to safety regulations. As such, you understand that there may be a possibility that the airline may not be able to accommodate your request to travel with an infant. B. Property/ Accommodation Upon request, Airpaz may prepare a list of recommended Properties/Accommodations for traveling with your family. As such, as part of their services, certain Properties/Accommodations may offer a kids club or daycare. iii. Government Taxes, Charges and Insurance Surcharges A. Flight Any government taxes, charges or insurance surcharge imposed on government owned airlines, relevant authority or the airport operator in respect of the use of any of our services or facilities will be charged to you in addition to our fares. Any administration fees and charges will be borne by you, unless otherwise stated by us. As such, government taxes, charges and insurance surcharge imposed on the airlines may change from time to time and can be imposed even after the date that your booking has been confirmed. You agree to bear such government taxes, charges or insurance surcharge when they fall due, which will be prior to your departure. B. Property Surcharges You understand that certain Property Facilities and Services, amenities, additional charges and surcharges resulting from using the Property/Accommodation’s paid services (such as spas, massages, Internet usage, parking, etc.) may be subject to additional fees charged by the Property/Accommodation. Such fees will be counted as additional fares. Depending on the nature of the additional charges, they may be charged to you prior to, during or after your stay. Such fees can vary, and may be modified from time to time. iv. Currency Fares and charges are payable in the currency listed within our published fares, unless otherwise specifically stated by the applicable airline and/or Property/Accommodation. Airpaz may list fare pricing in many currencies, but Airpaz only supports a certain number of booking currencies. The applicable currency will be provided during your booking process, more specifically, in the payment method section. If you pay in a currency that is different from the currency of the payment method that you selected, your credit or bank card issuer or third-party payment processor may apply a currency conversion rate or fees to your payment. Please contact your payment provider for information about rates and conversion fees which may apply, as these are not controlled by nor known by Airpaz. v. Accuracy of Fares, Schedules, Properties and Other Information All Ticket fares, flight schedules, list of Properties/Accommodations, routes published, pre-booked products and services are correct at the time of publication, however, the fares, flight schedules, list of Properties/Accommodations, routes published, pre-booked products and services are subject to change at any time, without prior notice. We will not be liable for any damages, losses, adverse effects or fines arising out of changes to the changes to Ticket fares, flight schedules, list of Properties/Accommodations, routes published, and pre-booked products and services. vii. Price Changes Prices listed on the Platform are subject to change. As such, the Ticket fares and pricing may change at any time, without prior notice. We reserve the right to modify or update the prices listed on the Platform at any time at our discretion. You will then be responsible for paying the difference prior to purchasing the Ticket. You further agree to waive any claims you had, may have or have against us arising out of or directly relating to the price change(s). We will not be liable for any damages, losses, adverse effects or fines arising out of pricing changes and increases. Please note that the price change will not apply to past invoices and previously purchased Tickets. viii. Government Imposed Taxes, Fees and Charges The price of your flight or Property/Accommodation may include taxes, fees, and charges which are imposed by government authorities. They may represent a significant portion of the cost of air travel or Property/Accommodation and are either included in the fare or shown separately on your Ticket. You may also be required to pay taxes or fees or other charges which are not stated. For example, it is not always possible to include all departure taxes on your flight Ticket(s). In some cases, the flight's departure taxes must be paid by you locally to the government of the country you are departing from and are therefore non-refundable by airlines.
8. Credit Card and Fraudulent Suspicion
We accept payments by credit card, and other payment methods listed on the Platform. If you choose to pay by credit card, you confirm to us that you are the lawful owner of the credit card information provided, or that you have secured all necessary authorizations to use the credit card. If you find any fraudulent suspicion or unauthorized use of your credit card, you must notify us immediately. If possible, we will cancel any pending transactions upon our receipt of your notification. We will not be responsible for any unauthorized usage of your credit card or payment information on the Platform. You must contact your bank or payment provider for assistance and you may not claim any compensation for losses or damages due to unauthorized, unlawful, or otherwise fraudulent usage of your credit card by a third party.
9. The Flight or Properties’ Booking
i. Booking Confirmation, Flight Changes, Property Reschedule A. Full payment is required to process your booking. Once your payment is received and successful, Airpaz will proceed to issue your booking or reservation. The booking is non-refundable. B. Unless otherwise specified, it is not possible for you to cancel your booking after making the payment. If the fare has not been paid in full or if your credit card or payment information is unusable, Airpaz reserves the right to cancel your booking. C. Proof of payment and booking status notification will be sent to you by way of email. When completing the booking information, you will be asked to provide your current email address for confirmation purposes. Booking confirmations can be also be obtained online, downloaded, and resent on Platform by using the manage booking feature in the “ORDERS” tab. D. Once a booking number has been issued to you, you are prohibited from substituting the Passenger(s) and/or Guest(s) named with another name or person. E. Any requests to change, reschedule or amend the Flight or Property/Accommodation booked should be submitted to us in writing on the Platform, under the “ORDERS” tab. Any requested changes will be handled by the third party service provider, namely, the relevant airline and/or Property/Accommodation, and will be subject to the third party service provider’s Terms and Conditions. Any requests for changes, rescheduling or amendments may be accepted or refused, at the third party service provider’s discretion, and may be subject to additional fees, which are non-refundable. F. To prevent duplicate bookings (2 or more bookings with the same details), please verify your booking details and status prior to making any payment. All duplicate booking refund policies are subject to the Terms and Conditions of the third party service provider (namely, the airline and/or the Property/Accommodation). ii. Flight or Property Booking Cancelation and Refund A. Upon purchasing bookings and reservations made through Airpaz, you will be deemed to have accepted and agreed to the third party service provider (namely, the airline and/or the Property/Accommodation)’s Terms and Conditions, especially with regard to cancelations and refunds. You understand that unless otherwise specified, all bookings are final, and may not be canceled or refunded. Further, we recommend that read the airline and/or Property/Accommodation’s Terms and Conditions carefully to avoid any violation. Airpaz will not be responsible in the event that you breach or violate the airline and/or Property/Accommodation’s Terms and Conditions. B. For flight or Property/Accommodation cancelation and refund requests, please submit your request through the Platform under the “ORDERS” tab. All the cancelations and refunds are subject to the Terms and Conditions set by the relevant airline and/or Property/Accommodation. You understand that any such requests may result in additional charges and penalty fees charged by the airline, Property/Accommodation, supplier, or even Airpaz. C. Any changes or cancelation flight from one of your flights (either departure or return flight) are subject to the refund policy set by the applicable airline. If the departure and return flight bookings are using different airlines, then the refund request will be treated as separated bookings and subject to each applicable airline’s Terms and Conditions. D. Flight Cancelation or Refund Requests – Any involuntary and voluntary cancelation and/or refund requests will be subject to the airline’s Terms and Conditions. Additional charges and fees by the airlines or properties (if any) may apply. You understand and agree that refunds amount will be reduced either by the processing fee or 3% of the total itinerary cost, depending on which amount is higher. E. Property/Accommodation Reservation Cancelation Requests – If the status of the Property/Accommodation reservation is refundable, please submit your refund request to our Customer Support via the Platform. If the Property/Accommodation reservation status is listed as non-refundable, no refund can be provided both for the booking or the fee. Refunds amount will be reduced either by the processing fee or 3% of the total itinerary cost, depending on which amount is higher. F. Airpaz will submit all eligible cancelation requests to the relevant airline, Property/Accommodation or supplier on your behalf. The refund amount and processing time are subject to the Terms and Conditions of the relevant airline, Property/Accommodation or supplier, and the decision of whether or not to issue a refund, including the amount of such refund (if approved) is at their sole discretion. Airpaz will not be responsible for any decision rendered by the relevant airline, Property/Accommodation or supplier, including the refusal to provide a refund. iii. Vouchers Airpaz will provide you with a “VOUCHER” in the event of a successful refund. Vouchers cannot be redeemed for monetary funds, and may only be used in accordance with the terms of the voucher. Voucher Refund Policy All vouchers are valid for one (1) year, and may only be used once (one-time use only) with no remaining balance after the use thereof. Airpaz will not offer a replacement for vouchers that are expired, canceled, or used improperly, whether due to fraud or technical issues. The voucher must be applied by using same currency as your original booking. You are not entitled to the remaining balance in your voucher for any reason. Any unused portion of the voucher is non-refundable, and cannot be redeemed for cash. iv. Cancellations by Airpaz Airpaz has the right to cancel your booking reasons deemed appropriate by Airpaz, at its discretion, which may include: •Breaches or violations of these Terms and Conditions, including but not limited to: a) Breaches committed by you in the past; b) Suspicious or confirmed fraudulent and theft activity (suspicious detail in the booking including inaccurate information), c) Suspicions that the bookings will be used for illegal or illicit purposes, or to carry out a criminal activity, d) prohibitions in law, e) services no longer available by the airline, Property/Accommodation or supplier, f) incomplete or refused payments, g) any conduct of yours which is abusive, insulting, or inappropriate, h) your failure to provide true and accurate information as part of your member account or when reserving the booking, i) you are known as or part of prohibited list by governments and any international organization. •Non sensible pricing on the Platform a) In case the booking is rejected or canceled by Airpaz and payment has been made, Airpaz will provide you with a voucher or full refund paid back to your original payment method. b) Airpaz may cancel or reject reservations due to a non sensible price shown the Platform, whereby the pricing is so unreasonable that no third party service provider can reasonably accept to proceed at such price.
10. Refund Guarantee and Travel Insurance
When purchasing a Ticket, you may have the option of purchasing our Refund Guarantee and Travel Insurance. This constitutes an add-on service we offer, and it is subject to an additional fee. For certain non-refundable bookings, you may be eligible for our Refund Guarantee and Travel Insurance if you purchased this add-on service. Please note that this add-on service will be provided by a third party service provider. The Refund Guarantee and Travel Insurance will grant you a full refund of the Ticket(s) purchased if the following conditions are met: (i) you cancel the booking, (ii) your cancellation complies with these Terms and Conditions, (iii) you validly purchased the Refund Guarantee and Travel Insurance and paid the fee for this add-on service, (iv) you complied with the third party service provider’s Terms and Conditions, and your cancellation falls under one of the approved causes listed by the third party service provider. Upon purchasing the Refund Guarantee and Travel Insurance and submitting a claim pursuant to this Refund Guarantee and Travel Insurance, you hereby agree that we can send your name and booking information to the relevant third party service provider. If you submit a claim pursuant to the Refund Guarantee and Travel Insurance to both Airpaz and the third party service provider, Airpaz reserves the right to discontinue and discard the claim submitted to Airpaz. Alternatively, in such case, if Airpaz does not discontinue and discard your claim, Airpaz may instead elect to demand the refund of any sums paid to you pursuant to your claim, to avoid double compensation. You understand that the decision to issue a refund pursuant to the Refund Guarantee and Travel Insurance will be made by the third party service provider. The decision made by the third party service provider is final and binding, and does not involve us. Any refunds issued pursuant to the Refund Guarantee and Travel Insurance will be provided by the relevant third party service provider. You understand we are solely acting as an intermediary with regard to the Refund Guarantee and Travel Insurance, and you agree to release us from all liability in connection therewith. In the event that your refundable booking claim is accepted and you are granted a full refund of funds paid, you hereby authorize Airpaz to cancel your Ticket subject to the approved claim. You further allow Airpaz to request and retain any partial refund of nonrefundable funds, which typically consists of taxes and seat selection. Airpaz will cancel your unused Ticket to avoid airline penalties, which may be charged if not canceled on time.
11. Airpaz Member Account and Personal Data
You hereby acknowledge and agree that your personal data which has been given to Airpaz (for the purposes of securing booking and purchasing Tickets) may be used to provide you booking confirmation, providing and developing ancillary services and facilities, facilitating immigration and entry procedures, accounting, billing and auditing, checking credit or other payment cards, security, administrative and legal purposes, credit card issuance, system testing, maintenance and development, statistical analysis in order to help Airpaz in the future dealings with you. You further agree that we may retain and use your personal data and transmit it to our own offices, authorized agents, third party business associates, airlines owned government agencies and other carriers or service providers for purposes of providing the services and fulfilling your requests. Airpaz reserves the right to delete or remove any member account on the Platform, on a temporary or permanent basis. Once your member account is deleted or removed, you may not use the Platform. It is prohibited for you to make purchases on the Platform using a fictitious name or other member account.
12. Travel Documentation
On the day of your departure, you must bring your booking confirmation, e-tickets and any other travel documentation (including your identity card, passport and relevant visa). These documents will be required at the check-in counter. Airpaz will not be liable if you are not provided with the booked product or service due to not presenting the required travel documentation. You are responsible for obtaining and having the entirety of the travel documentation available for presentation purposes as required by the relevant authorities, and all entry and exit, health, the documents required by law, regulations, order, demands or requirements of the countries flown from, into or over. Airpaz may ask you to verify your identity, or provide proof of your identity to process requested booking changes, such as rescheduling or correcting travelers' data. You are obligated to provide us with the identification information requested as it is part of the booking changes procedure.
13. Intellectual Property Rights
Trademarks, logos, trade names, marks and intellectual property relating to Airpaz are proprietary to Airpaz. Airpaz’s trademarks and logos may not be reproduced or shared without Airpaz’s explicit prior written consent. All intellectual property directly relating to the Platform and Airpaz remains Airpaz’s sole property. Airpaz is the exclusive owner of such intellectual property throughout the world, without limitations of time or space. Any content that has been licensed to Airpaz, such as airline logos and hotel logos and third party intellectual property, remains the property of its respective owners. Please note that the transmission, sharing, distribution and reproduction of all or part of any the content on the Platform is expressly prohibited, except as provided under these Terms and Conditions. You are permitted to print and copy portions of the Platform solely for personal, non-commercial use and reference purposes. We do not permit the reproduction, modification, or transmission of the intellectual property on the Platform for business or commercial gain, except with our prior specific written consent.
14. Usage Restrictions
When you are accessing and using the Platform, you agree to comply with the following obligations: • Your usage of the Platform, your purchase of Tickets and usage thereof will comply with all applicable laws and regulations. • You agree not to use the Platform for unauthorized or illegal activity. • You may not impair, interfere with or damage the Platform or its servers. • You may not send or transmit harmful files, viruses or damaging components. • You may not use automated means, including spiders, robots, crawlers, data mining tools, or the like to download or scrape data from the Platform. • You may not engage in unlawful or illegal conduct, or encourage other users to use the Platform for such illicit purposes. • You may not decompile or hack any portion of the Platform or attempt to decompile or hack the Platform or any portion thereof. • You may not sell, lease, assign or transfer your member account on the Platform. • You may not engage in conduct that conflicts with these Terms and Conditions. You may be held responsible for your failure to comply with these Terms and Conditions, and our standards. Further, you agree that we may, without liability, revoke your right to use the Platform if you breached or attempted to breach any of these Terms and Conditions.
15. Disclaimers
By using the Platform and our services, you hereby acknowledge and agree that: i. Airpaz does not guarantee that the services provided are free from errors, viruses or failure. If there is any error or failure, it may be repaired by us at our earliest convenience. Nonetheless, Airpaz does not guarantee that any errors or failures will be repaired in a timely manner, or even at all. ii. Airpaz is not responsible if there is an inaccuracy or error in the listings provided on the Platform. iii. Airpaz will not be responsible if you suffer losses or damages due to incomplete, incorrect or faulty documentation you provided. iv. Airpaz will not be held liable if you feel the Star Ratings provided are inaccurate and misleading. v. Airpaz acts as an official agent on behalf of the operators. We do not provide the transport services, thus we are only responsible for our booking service itself.
16. Limitations of Liability
The Platform and listings provided thereon are provided “as is” and “as available”, without any warranties or guarantees of any kind. Airpaz cannot guarantee that the Platform and listings will be continuously available, error-free and uninterrupted. While Airpaz will attempt to correct issued or defects, Airpaz cannot guarantee that issues or defects shall be corrected promptly or corrected at all. There are well known risks associated with any online activity. Accordingly, Airpaz cannot guarantee that the Platform will be free of harmful components, such as viruses. In consideration thereof, you agree that your usage of the Platform will be at your sole risk. Technical issues may arise when using the Platform. Such issues may suspend, delay or prevent access to the Platform. Airpaz disclaims all liability for: (i) any issue affecting Airpaz’s servers, including unauthorized access; (ii) service interruptions or other issues affecting the availability of the Platform; and (iii) any harmful component, such as viruses, worms and spyware, impairing the Platform or your device. To the fullest extent permitted by applicable law, Airpaz will not be responsible for any losses and damages arising out of or in connection with the Platform, including but not limited to indirect, general, special, punitive, accessory and incidental damages. This exclusion of liability applies even if Airpaz was aware of the possibility of such damages arising. Notwithstanding anything to the contrary contained in these Terms and Conditions, if Airpaz is delayed, hindered in or prevented from the performance of any obligation or act required under these Terms and Conditions by reason of a Force Majeure event (including acts of God, strikes, lockouts, pandemics, epidemics, governmental acts or regulations, or any natural disaster), the performance of such obligation or act shall be excused for the duration of the Force Majeure event. If you provided erroneous information as part of your booking or elsewhere, we will not be held responsible if you fail to receive the Ticket, or for issues caused by or in connection with your booking. Accordingly, if you provided us with incorrect information regarding your email address, we will not be responsible for sending the appropriate information to the incorrect email address provided. You are responsible for ensuring the information provided on the Platform and as part of your booking (including contact details and passenger information) is correct and true to the best of your knowledge.
17. Governing Law and Dispute Resolution
These Terms and Conditions will be governed by the laws of Singapore (excluding any conflict of laws rule or principle, which might refer such interpretation to the laws of another jurisdiction). Any disputes or claims arising out of these Terms and Conditions (excluding any claims Airpaz has for injunctive or other equitable relief) will be resolved by binding arbitration. All arbitration proceedings shall be brought in your individual capacity, and not as a class action. The arbitrator may not consolidate more than one user’s claims. The arbitration proceedings will take place in Singapore. The award rendered by the arbitrator will include costs of arbitration, and other applicable costs. Any judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction. Nonetheless, nothing in these Terms and Conditions will prevent Airpaz from seeking injunctive or other equitable relief from the courts as necessary to prevent the actual or threatened infringement, misappropriation, or violation of data security, intellectual property rights, or other rights.
18. General Provisions
The language of these Terms and Conditions is in English. Even though there are translations in another language to these Terms and Conditions, the English version will control and prevail in case of a discrepancy. These Terms and Conditions, together with other documents to be delivered hereunder, constitute the entire agreement between you and us pertaining to the subject matter hereof and supersede all prior agreements, whether oral or written. If any provision or section in these Terms and Conditions is held to be unenforceable or unlawful, such provision or section will be severed from these Terms and Conditions. Any severed or redrafted provision or section will not affect the enforceability of the remaining provisions of these Terms and Conditions. Airpaz may assign its rights and obligations in these Terms and Conditions without limitation. You may not assign all or part of your rights and obligations in these Terms and Conditions, except with the prior written consent of Airpaz. If Airpaz suspends, delays or does not exercise any rights granted to it under these Terms and Conditions, this will not serve as a waiver of Airpaz’s rights. You acknowledge and agree that Airpaz may send them emails regarding these Terms and Conditions, the Platform, booking, Tickets and any matters contemplated under these Terms and Conditions. You are required to provide your correct email address. As such, any emails sent by Airpaz to the email address you provided will be deemed effective.
